Pennsylvania uses the Total Loss Formula (TLF) rather than a fixed percentage threshold. Under 75 Pa. C.S. § 102, a vehicle is a total loss when the cost of repairs plus the salvage value of the damaged vehicle equals or exceeds the vehicle's actual cash value (Total Loss Appraisals – Pennsylvania; ADR-Claims – Pennsylvania TLT).


Worked example. A 2022 Honda Accord with an ACV of $24,000, repair cost of $17,000, and salvage value of $8,000 satisfies the TLF: $17,000 + $8,000 = $25,000, which exceeds the $24,000 ACV. The insurer can declare a total loss even though the repair cost alone is only 71% of ACV — well under any percentage threshold.

Good-faith duty in adjustment. The Pennsylvania Supreme Court in Berg v. Nationwide Mutual Insurance Co., 235 A.3d 1223, 1232 (Pa. 2020) (per curiam), reaffirmed that an auto insurer must "act with the 'utmost good faith' toward its insureds." That duty applies to total loss valuation. An insurer that produces a CCC ONE or Mitchell report with stale comparables, misapplied condition adjustments, or uncredited options may be exposed to bad-faith liability under 42 Pa. C.S. § 8371 in addition to a contract-based valuation dispute (McNees – Car Crash Property Damage Fair Value).

Practical Implications

  • Because PA is a TLF state, insurers can total newer, lightly damaged vehicles when salvage value is high (luxury, EV, or in-demand vehicles often produce a counterintuitive total loss).


  • The short two-year statute of limitations means owners disputing a total loss should act quickly.



  • The combination of TLF and Berg makes Pennsylvania one of the better jurisdictions for bringing bad-faith pressure into a valuation dispute.
